Earlier in the week we linked to Clayton’s mashup of the Beach Boys’ “Pet Sounds” and the Beatles “Sgt Pepper’s Lonely Hearts Club.” Well, this morning I received an e-mail from Clayton saying that Capitol and EMI Records have sued him because of his mashup. Read more here. Keep in mind, Clayton offered the downloads for free – he never made any money off of it.
This really demonstrates how copyright law is broken. Could you imagine any money being lost by either the Beach Boys or the Beatles over the mashup? Incredibly doubtful. No one is going to be downloading that work for free and then deciding they don’t need to buy either of the original properties.
if i was being sued by capitol and emi, i don’t think i’d be talking so much crap about them. i would hope they’d just drop the whole thing.
I applaud Mr. Counts for taking a stand. About time somebody did!
Not sure what kind of grounds the label has in this situation. Paint companies don’t sue visual artists for the paintings they make, and film companies don’t sue photographers for the photos they take. Clayton could make a great argument for his rights as an artist to disassemble and reassemble pre-existing material to make something new (even if it does totally sound like crap).
Wait, I take it all back. I hope they sue the pants off of him. Dude said “FUCK Crowded House.” It’s obvious he sucks.
Not to get too technical, but the law is the COPYright, not the PROFITright. The entire law is based on the right to copy, and not the right to sell.

I’ve just been letting everything pass me by lately. Maybe tomorrow. Today was a complete loss, but that’s how it is. Eh. Oh well.
My mind is like a fog. Oh well. My life’s been really dull today. Eh. Today was a total loss. I’ve more or less been doing nothing , but I guess it doesn’t bother me.
